La ley Conan: Nozick, los derechos de los animales y el giro político en la ética animal

En Argentina fue propuesta recientemente una iniciativa de ley sobre el maltrato animal que amplía el catálogo de acciones que son calificadas como tal y endurece los castigos consecuentes. La propuesta, conocida públicamente como ley Conan, ha sido criticada por quienes sostienen que una iniciativa de este tipo es contraria al libertarismo propugnado por el presidente de ese país. En este artículo evalúo críticamente esta supuesta incompatibilidad entre el libertarismo y los derechos de los animales. Particularmente, propongo que las reflexiones de Nozick sobre los animales en Anarquía, Estado y utopía constituyen un punto de partida privilegiado para articular un libertarismo abierto al reconocimiento de derechos para los animales. Pero en lugar de centrarme en su conocida propuesta “kantismo para las personas, utilitarismo para los animales”, defiendo la idea de que los animales son capaces de tener vidas significativas y que, por lo tanto, son el tipo de seres de quienes pueden predicarse derechos.
